1. Acceptance of Terms

By accessing or using AtomicX Chat ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

AtomicX Chat provides an AI-powered chat platform that enables businesses to deploy chatbots on their websites. The Service includes a chat widget, conversation management dashboard, AI-powered response generation, workflow builder, analytics, and integrations with third-party services.

3. User Accounts

• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• One person or organization may not maintain more than one free account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Send spam, phishing messages, or other unsolicited communications.
• Distribute malware, viruses, or other harmful code.
• Impersonate any person or entity.
• Collect personal data from chat visitors without proper consent and disclosure.
• Use the AI capabilities to generate harmful, misleading, or illegal content.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.

5. Payment Terms

• Paid plans are billed in advance on a monthly or annual basis.
• All fees are non-refundable unless otherwise stated in your plan or required by law.
• We reserve the right to change pricing with 30 days' notice.
• Usage exceeding plan limits may result in additional charges or service restrictions.

6. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by AtomicX Chat and protected by intellectual property laws. You retain ownership of:

• Content you upload to the Service (knowledge base documents, training data).
• Your brand assets and customizations applied to the chat widget.
• Conversation data generated through your use of the Service.

You grant us a limited license to use your content solely for the purpose of providing the Service.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our reasonable control.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOMICX CHAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

• You may cancel your account at any time through the dashboard settings.
• We may suspend or terminate accounts that violate these Terms.
• Upon termination, your right to use the Service ceases immediately.
• We will retain your data for 30 days after termination, after which it will be permanently deleted.

10. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AtomicX Chat operates, without regard to conflict of law principles.
